America is notorious for litigation. Much of this is cultural, but it is also driven by the general, default rule that parties pay for their own attorney’s fees. The general rule in Europe and most countries is that the losing party pays the prevailing party’s attorney’s fees, or at least reasonable attorney’s fees. (more…)
